Flow 3 Drains - Terms & Conditions

These Terms and Conditions govern the provision of services by Flow 3 Drains (UK) Ltd (“we”, “us”, “our”) to clients (“you”, “your”). By commissioning our services, you agree to be bound by these terms. These are especially relevant for Councils, Housing Associations, and commercial property management clients.

1. Scope of Services
Flow 3 Drains provides drainage services including blockage clearance, CCTV surveys, tanking, drain repair, lining, maintenance, and gutter clearance. Services are performed as per agreed work orders, quotations, or frameworks, subject to reasonable access and cooperation from clients or tenants.

2. Access & Delays
Clients must ensure unhindered access to sites as agreed. If access is delayed or denied, an abortive visit fee may apply. We reserve the right to reschedule works where access restrictions pose safety or timing issues. Delays not caused by us may impact delivery timescales.

3. Health, Safety & Compliance
All operatives are trained in accordance with health and safety regulations. We provide Risk Assessments and Method Statements (RAMS) upon request. Sites must comply with safety expectations and clients must disclose known hazards prior to works commencing.

4. Payment Terms
Invoices are due within 30 days unless otherwise agreed in writing. Public sector frameworks may allow for 45-day payment terms. Interest may accrue on overdue balances under the Late Payment of Commercial Debts (Interest) Act 1998. We reserve the right to suspend services for unpaid invoices.

5. Warranty & Defects
We warrant workmanship for a period of 12 months on repairs, this does not apply to blockages, subject to fair use and no third-party interference. CCTV diagnostics or maintenance do not carry warranty. Defects must be reported within 7 days of discovery and access granted for resolution.

6. Liability
We shall not be liable for indirect or consequential losses. Our liability is limited to the value of the works performed. We are not responsible for damage caused by pre-existing structural defects or customer misuse.

7. Force Majeure
We are not liable for delay or failure due to events outside our control, including extreme weather, supply chain disruption, or industrial action.

8. Governing Law
These terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of English courts.
